1. Ką reiškia ši Privacy Policy?

Šioje privatumo politikoje (toliau – Privacy Policy) Jums pateikiame informaciją apie tai, kaip [UAB „Dzūkų žinios“] (toliau – Įmonė arba Duomenų valdytojas), tvarko Jūsų asmens duomenis gautus: (i) Jums naudojantis internetine svetaine https://www.capsule.lt (toliau – Interneto svetainė); (ii) Įmonei vykdant tiesioginę rinkodarą; (iii) siekiant Įmonei apginti jos teises; (iv) siekiant užtikrinti konfidencialios informacijos apsaugą ir veiklos tęstinumą; (v) siekiant įvykdyti sutartis, sudarytas tarp Įmonės ir kontrahentų – juridinių asmenų; (vi) Jums lankantis Įmonės Interneto svetainėje ar Įmonės socialinės žiniasklaidos tinklų paskyrose. Toliau visi nurodyti asmenys, kurių duomenis tvarko Duomenų valdytojas vadinami – Duomenų subjektais.

2. About Duomenų valdytoją

Duomenų valdytojas reiškia [UAB „Dzūkų žinios“], juridinio asmens kodas [165118225], buveinės adresas [Seinų g. 12, Lazdijai, LT-67114], Lietuvos Respublika, duomenys apie Įmonę kaupiami ir saugojami Lietuvos Respublikos juridinių asmenų registre. 3. What is personal data?

Personal data means any information collected by the Company about a Data Subject that can be used to identify that person and is stored electronically or in another form.
Personal data includes any information, including the name, surname, address of the Data Subject, which the Company collects about the Data Subjects for the purposes specified in this Privacy Policy or in a separate Data Subject consent or agreement with the Company.

4. Personal data that is processed when providing/receiving electronic services (user account)

If you create a registered user account on the Website, we process the personal data required to perform the electronic services agreement (user account) and to contact you about its performance: first name, surname, email address and telephone number. The legal basis is Article 6(1)(b) GDPR (performance of a contract or steps taken at your request before entering into a contract).
We will process additional data such as company name, address, company registration number and taxpayer identification number for data subjects who act as employees of legal entities. The legal basis for data processing is Article 6, Paragraph 1, Clause F of the GDPR (legitimate interest in performing the contract).
We store your data until your user account is deleted, or when the account has not been accessed for 3 years.

5. Personal data that is processed when you purchase goods on the website

To perform a Goods Purchase Agreement concluded with you after you place an Order and accept the Terms, and to contact you about its performance, we process: first name, surname, email address, delivery address, telephone number, payment details (such as a bank account number), VAT invoice details, information about completed, rejected or failed payments, and information about returned Goods. The legal basis is Article 6(1)(b) GDPR (performance of a contract or steps taken at your request before entering into a contract).
We will process additional data such as company name, address, company registration number and taxpayer identification number for data subjects who act as employees of legal entities. The legal basis for data processing is Article 6, Paragraph 1, Clause F of the GDPR (legitimate interest in performing the contract).
Data confirming the fact of the conclusion of the Goods purchase – sale agreement and information and accounting documents related to the conclusion of the agreement will be stored for 10 years after the conclusion of the Goods purchase – sale agreement, and other information for 5 years.

6. Personal data is processed in order to defend the Company’s rights

We process personal data to recover debts and other amounts due, to bring or pursue legal claims and, where necessary, to defend against claims, on the basis of our legitimate interests. For these purposes we may process: first name, surname, email address, postal address, telephone number, payment details (such as a bank account number), VAT invoice details, the code of an individual enterprise or the number of a business licence or individual activity certificate, and other information relating to the dispute.
The legal basis for data processing is Article 6, Part 1, Clause F of the GDPR (legitimate interest basis).
The specified data is stored for 1 year after the final resolution of the dispute.

7. Direct marketing

To persons who have reached the age of 14, who have provided their contact details and have expressed a desire to receive information about the goods and/or services offered by the Company, we will send offers for the sale of the Company’s goods or services, newsletters and other advertising materials, and inform about the Company’s news by means of electronic communication (e-mail, telephone, SMS messages).
For the purpose of direct marketing, the Company will process your personal data: telephone number, e-mail address (mandatory data, without which we will not be able to send you direct marketing communications). Your data will be processed for direct marketing purposes for 3 years from the date of consent.
If you have purchased goods or services distributed by the Company and have not objected to receiving direct marketing communications from the Company (e.g. by ticking the box of objection in the direct marketing consent form), we will send you communications by e-mail based on our legitimate interest regarding goods or services that are similar to the services provided to you or the goods sold. In this case, your data will be processed for the purpose of direct marketing for 1 year after the purchase of the last product or service or the end of the long-term contract.
You may object to or opt out of direct marketing communications at any time by contacting us at the email address specified in section 2.

8. Protection of the Company’s confidential information and business continuity

In order to ensure its legitimate interest in protecting the Company’s confidential information and the Company’s business continuity, the Company may review the correspondence of its employees with contractors. In order to achieve these goals, the Company processes the following personal data of its employees and persons who send or receive employee letters: e-mail address, content of information contained in electronic work tools. Such data is stored for 4 years.

9. Performance of the Company’s agreements with corporate counterparties

To pursue its legitimate interest in performing agreements with corporate counterparties, the Company processes personal data of their employees: first name, surname, email address, telephone number and correspondence content. Communication data is stored for 4 years; information relating to or contained in the agreement is stored for 10 years after the agreement ends.

10. Contact us

You may contact the Company by telephone or email. We receive, review and respond to messages directly. If you contact us, we may process the data you provide, including your first name, surname, email address, telephone number, the date and the content of correspondence.
Such data will be processed in order to answer your questions and examine your proposals. If you do not provide your contact details, it will not be possible to contact you.
Correspondence is stored for 1 year after receiving the message, with the exception of information for which other terms are set in the Privacy Policy or legal acts.
Any personal data you provide when communicating with us is used only for the above purposes and to review messages and administer and manage communication flows. We undertake not to use your personal data in any publications without your express consent in such a way that it is possible to determine your personal identity.

We process the information provided in our accounts for the purpose of account administration on the basis of your consent.

13. Collection and disclosure of data

We receive your data from you, your devices, our employees and our contractual partners.
We may disclose information about you to our employees, intermediaries, service providers, such as debt administration or collection companies, marketing services, IT service providers or subcontractors, if reasonably necessary for the purposes described in this Privacy Policy.
In addition, we may disclose information about you:
● if we are required to do so by law;
● to defend our rights or interests, including disclosing your data to third parties in order to recover amounts you owe us;
● intending to sell a part of the Company’s activity or its assets, disclosing your personal data to a potential buyer of the activity or its part;
● after selling the Company’s activities or a substantial part of its assets to third parties.
Except as provided in this Privacy Policy, we do not provide your personal data to any third parties.
The list or categories of recipients stated in this Privacy Policy may change. If you wish to be informed about changes to the recipients of your personal data, email us at the address stated in this Privacy Policy and write: “I wish to receive information about changes to the recipients of my personal data”, followed by your first name and surname.

14. Security of your personal data

Your personal data will be processed in accordance with the requirements established by the General Data Protection Regulation, the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts. When processing your personal data, we implement organizational and technical measures that ensure the protection of personal data against accidental or illegal destruction, alteration, disclosure, as well as against any other illegal processing.

15. Your rights

This section explains your rights in relation to our processing of your personal data and when they may be exercised. To obtain more information or exercise a right, contact us at the email address stated in this Privacy Policy.
The company will provide you with information about the actions taken after receiving your request regarding the exercise of your rights without undue delay, but no later than within 1 (one) month after receiving the request. Considering the complexity of the request and the number of requests received, the aforementioned term may be extended for another 2 (two) months. In this case, we will inform you about such extension of the deadline and the reasons for it within 1 (one) month after receiving the request. The company will refuse to exercise your rights only in the cases provided for by law.

15.1. The right to access your personal data

We want you to understand fully how we use your personal data. You may ask us at any time whether we process your personal data. If we store or otherwise use it, you have the right to access it. To do so, send a written request to the email address stated in this Privacy Policy, verify your identity and act in accordance with the principles of good faith and reasonableness.

15.2. Right to withdraw consent

If you have given us explicit consent for the processing of your data, you can withdraw it at any time.

15.3. Additional Rights

Below we provide information about the additional rights you have, which you can exercise in accordance with the procedure described below.
(a) You have the right to ask us to correct any inaccuracies in the data we hold. In this case, we may ask you to confirm the corrected information.
(b) You have the right to ask us to delete your personal data. This right is exercised in the cases provided for in Article 17 of the General Data Protection Regulation (EU) 2016/679.
(c) You have the right to ask us to limit the processing of your personal data or not to process it:

● for the period necessary for us to verify the accuracy of your personal data when you make claims about the accuracy of the data;
● when our collection, storage or use of your personal data is illegal, but you decide not to request data deletion;
● when we no longer need your personal data, but you need it to establish, fulfill or defend a legal claim;
● for the period required to determine whether we have an overriding legal basis to continue processing your personal data, if you have exercised your right to object to the processing of personal data.

(d) You have the right to the transfer of data that is processed by automated means and that we have received from you with your consent or for the purpose of entering into a contract. After you exercise this right, we will transfer a copy of the data you provided at your request.
(e) Under Article 21 GDPR, you have the right to object to our processing of your personal data where the processing is based on legitimate interests (the legal basis is stated for each purpose above) or is carried out for direct marketing.

15.4. Right to request more information

We hope that you understand that it is very difficult to discuss all possible ways of collecting and using personal data. We strive to provide the clearest and most complete information possible and undertake to update this Privacy Policy if the process of using personal data changes. 16. Complaints

If you believe that your rights as a Data Subject have been or may be infringed, please contact us immediately at the email address stated in this Privacy Policy. After receiving your complaint, we will contact you within a reasonable time and inform you about the progress and outcome of our investigation.

17. Liability

We are not liable for loss resulting from inaccurate or incomplete personal data supplied by you or from your failure to notify us of changes.

18. Changes to Privacy Policy

We may update or amend this Privacy Policy at any time. If you wish to receive an updated copy, contact us at the email address stated in section 2.
